Terms of Service

These Terms of Service ("Terms") govern use of The Aussie Clothing Company online store and purchases made through it. By using the store or submitting an order, you agree to these Terms, our Privacy Policy, Shipping Policy, and Return, Replacement, and Refund Policy.

Nothing in these Terms limits rights or remedies that cannot legally be excluded.

STORE USE

You may use the store only for lawful, personal shopping purposes. You must not misuse the store, interfere with its operation or security, attempt unauthorized access, introduce harmful code, scrape or copy store content contrary to law, impersonate another person, submit fraudulent information, or use the store to violate another person's rights.

You are responsible for the accuracy of information supplied with an order or account and for maintaining the confidentiality of account credentials.

PRODUCTS AND DESCRIPTIONS

We aim to describe products accurately. Screens, lighting, garment batches, printing processes, and permitted production tolerances can cause reasonable differences in colour, texture, dimensions, and print placement. Product-specific descriptions and size charts should be reviewed before ordering.

A reasonable production variation is not automatically a defect. This does not exclude a remedy where an item is defective, materially misdescribed, or fails to meet a non-waivable legal standard.

PRICING, CURRENCY, AND TAXES

Prices, discounts, shipping charges, currencies, and taxes shown before checkout may change before an order is submitted. The final checkout review displays the amount offered for that transaction. Obvious typographical, technical, or pricing errors do not require us to fulfil an order at the erroneous amount; if payment was captured, the affected amount will be refunded.

Customers are responsible for charges disclosed at checkout and any government charges lawfully imposed on the transaction unless checkout states that we will pay them.

ORDERS AND ACCEPTANCE

Submitting an order is an offer to purchase. An automated confirmation acknowledges receipt but does not require us to accept an order. We may refuse or cancel an order before fulfilment for legitimate reasons, including suspected fraud, payment failure, product unavailability, destination restrictions, pricing or listing errors, policy abuse, or legal requirements.

If we cancel an order after payment was captured, we will refund the affected amount to the original payment method. We will not substitute a materially different product without the customer's agreement.

MADE-TO-ORDER PRODUCTION

Products are generally made after an order is accepted. Production can begin quickly. Requests to change or cancel an order are not guaranteed after submission and are unavailable after production begins unless required by law. SHIPPING AND DELIVERY

We currently serve eligible addresses in Canada and the United States. Shipping availability, charges, and currency are confirmed at checkout. Delivery dates are estimates unless expressly stated otherwise.

The Shipping Policy forms part of these Terms and covers production, delays, tracking, split shipments, address accuracy, and failed delivery. Where applicable law requires a delay notice, cancellation option, replacement, or refund, we will provide it.

RETURNS, REPLACEMENTS, AND REFUNDS

Because products are made to order, we do not offer preference-based returns, refunds, exchanges, or free remakes for change of mind or an incorrectly selected size or colour, except where required by law.

The Return, Replacement, and Refund Policy forms part of these Terms. It explains reporting periods, evidence, unauthorized returns, customer-caused delivery failures, cancellations, and remedies for damaged, defective, materially misprinted, incorrect, lost, or legally non-conforming orders.

PROMOTIONS AND DISCOUNT CODES

Promotions and discount codes may have separate conditions, expiry dates, product or destination restrictions, and single-use limits. They have no cash value, cannot be applied after purchase, and cannot be combined unless expressly stated. We may correct or withdraw a promotion affected by error, fraud, or misuse, subject to applicable law.

INTELLECTUAL PROPERTY

The store's branding, original text, graphics, artwork, layout, and other content are owned by us or used with permission and are protected by applicable intellectual-property laws. No store content may be reproduced, sold, modified, distributed, or used commercially without permission, except as allowed by law.

Third-party names and marks belong to their respective owners. References to Australia or other places do not imply government, certification-body, brand, league, celebrity, or other third-party affiliation.

THIRD-PARTY SERVICES AND LINKS

The store relies on third-party services, including its ecommerce platform, payment providers, production and fulfilment partners, and carriers. Third-party links may be provided for convenience. We are not responsible for independent third-party sites or services, but using a fulfilment provider does not remove any responsibility we have to customers under applicable law.

DISCLAIMER

To the maximum extent permitted by law, the store and its content are provided on an "as available" basis. We do not promise uninterrupted or error-free access and are not responsible for events outside our reasonable control. Product warranties and remedies are limited to those expressly stated in our policies or required by law.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential loss, including lost profits or lost opportunities, arising from use of the store or a purchase.

For claims not involving rights that cannot be limited, our total liability relating to an order will not exceed the amount paid for the affected order. These limits do not apply to liability that applicable law prohibits us from excluding or limiting.

CUSTOMER RESPONSIBILITY AND MISUSE

You are responsible for loss reasonably caused by your fraud, unlawful conduct, intentional misuse of the store, or material breach of these Terms. We may suspend access, refuse service, cancel an unfulfilled order, or take reasonable protective action where permitted by law.

CHANGES TO THESE TERMS

We may update these Terms for future use of the store. The current version and effective date will be posted on the store. Changes do not retroactively reduce rights attached to an order already accepted unless required by law or agreed with the customer.

SEVERABILITY AND WAIVER

If part of these Terms is found unenforceable, the remaining provisions continue to the extent permitted by law. A delay in enforcing a provision is not a waiver of the right to enforce it later.

APPLICABLE LAW

These Terms are governed by the laws applicable to the transaction and the merchant, without excluding mandatory consumer protections or any forum rights that cannot legally be waived.
